Terms of Service

These Terms of Service (“Terms”) govern access to and use of AdmitFirst, provided by Haivanti (“Haivanti,” “we,” “us”). By using the Service, you agree to these Terms.

1. The Service

AdmitFirst provides AI voice and chat agents that answer admissions inquiries and resident concerns for senior-care facilities, capture the details, notify facility staff, and present the results in a dashboard. We provide the Service to facilities (“Facilities”) and their authorized staff.

2. Accounts

Dashboard accounts are for authorized Facility staff only. You are responsible for keeping your credentials secure and for activity under your account. Notify us promptly of any unauthorized use.

3. Facility responsibilities

  • Configure accurate notification recipients within your organization.
  • Ensure you have a lawful basis to collect and process information about prospective residents, callers, and families, and provide any legally required notices, including for call recording.
  • Execute a Business Associate Agreement with us where protected health information is involved.

4. Acceptable use

You agree not to:

  • Use the Service unlawfully or to violate the rights of others.
  • Use it to contact individuals without a lawful basis, or to send unsolicited messages.
  • Reverse engineer, disrupt, or attempt to gain unauthorized access to the Service.

5. Third-party services

The Service relies on third-party providers, including Retell AI, Amazon Web Services, Google, and OpenRouter. Your use of the Service is also subject to those providers’ terms where applicable.

6. Intellectual property

We and our licensors own the Service and all related software and content. We grant you a limited, non-exclusive, non-transferable right to use the Service in accordance with these Terms.

7. Disclaimers

The Service is provided “as is” and “as available.” It is an intake and routing tool, not a provider of medical, legal, or professional advice, and it does not make care decisions. We do not warrant that the Service will be uninterrupted or error-free.

8. Limitation of liability

To the maximum extent permitted by law, Haivanti will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits or revenues, arising out of or related to your use of the Service.

9. Indemnification

You agree to indemnify and hold Haivanti harmless from claims arising out of your misuse of the Service or breach of these Terms.

10. Termination

We may suspend or terminate access if these Terms are violated or as needed to protect the Service. You may stop using the Service at any time.

11. Governing law

These Terms are governed by the laws of the United States and the state in which Haivanti is organized, without regard to conflict-of-laws principles.

12. Changes

We may update these Terms from time to time. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

13. SMS program (AdmitFirst SMS Alerts)

Program name: AdmitFirst SMS Alerts. We send operational SMS text alerts to authorized Facility staff to notify them of a new admissions inquiry or resident concern, each with a link to log in and respond. These are transactional messages, not marketing.

Staff opt in inside their AdmitFirst account on the Setup page by checking the SMS consent box, which is unchecked by default, and entering the numbers that should receive alerts. Consent is not a condition of using the Service. Message frequency varies, and message and data rates may apply. Reply STOP to opt out and HELP for help; we honor these automatically, and staff can also revoke consent on the Setup page. For help with the SMS program, email avi@haivanti.com.
